These Terms and Conditions ("Terms") govern your use of Chirp.QR. By downloading, installing, accessing, or using the Chirp.QR iOS app, the Chirp.QR website at chirpqr.com, the Chirp Premium subscription, or our school licensing service at chirpqr.com/schools (together, the "Service"), you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Chirp.QR is operated from Sweden by Sammy Pálsson. For privacy information, please see our Privacy Policy, which forms part of these Terms.
1. About the Service
Chirp.QR lets you record audio on an iPhone or iPad and generate a QR code that links to the recording, so that anyone with a smartphone camera can scan the code and play the audio in a web browser — no app required for listeners.
The Service consists of:
- The Chirp.QR iOS app, available on the Apple App Store.
- The Chirp.QR website at chirpqr.com, including the public playback pages for shared QR codes.
- The Chirp Premium subscription (in-app purchase via Apple).
- The Chirp.QR school licensing service at chirpqr.com/schools.
2. Eligibility and Accounts
- Free use of the iOS app — The iOS app does not require an account. Anyone with a compatible iPhone or iPad can install it and create audio QR codes within the daily limits of the free tier.
- Chirp Premium — The Chirp Premium subscription is purchased through your Apple ID. You must comply with Apple's Media Services Terms and Conditions in addition to these Terms.
- School licence accounts — School licences at chirpqr.com/schools are intended for school administrators or other adult representatives with authority to purchase on behalf of the school. The person creating a school account must be at least 18 years old and have legal capacity to enter into a binding agreement on behalf of the school.
- Use by children — Chirp.QR may be used by children under appropriate adult supervision, including under a school licence. See our Privacy Policy Sections 7 and 8 for how we handle children's data.
3. Subscriptions, Payment, and Renewals
Free tier. Chirp.QR is free to use within the daily recording limits set out in the app. The free tier may change from time to time; we will not retroactively remove access to recordings you have already made and uploaded under prior limits.
Chirp Premium (individual subscription). Chirp Premium is an auto-renewing in-app subscription purchased through your Apple ID. Pricing is shown in the App Store at the time of purchase and may vary by region. The subscription auto-renews unless cancelled at least 24 hours before the end of the current billing period through your Apple ID subscription settings. We do not manage Chirp Premium billing directly; refund requests should be directed to Apple Support.
School licensing. A school licence is an annual subscription purchased through chirpqr.com/schools. Pricing is volume-tiered based on the number of devices licensed and is shown at checkout. Schools may pay by card (processed by Stripe) or request an invoice for bank transfer. School licences auto-renew at the end of each annual period unless the school cancels through the school dashboard at chirpqr.com/schools. We will send a renewal reminder before each renewal.
Cancellation. You can cancel at any time. For Chirp Premium, cancel through your Apple ID subscription settings. For a school licence, cancel through the school dashboard at chirpqr.com/schools. Cancellation takes effect at the end of the current paid period; we do not pro-rate refunds for partial periods of use unless required by law.
Taxes. Prices shown on chirpqr.com/schools are exclusive of VAT unless stated otherwise. Applicable VAT will be added at checkout based on the school's billing address. School customers may provide a valid VAT number for intra-EU transactions where reverse charge applies.
4. Your Content
- Ownership. You retain all rights to the audio recordings and other content you create or upload through Chirp.QR. We do not claim ownership of your content.
- Licence to us. By uploading content to Chirp.QR, you grant us a worldwide, non-exclusive, royalty-free licence to store, host, transmit, and display that content solely as needed to operate the Service — for example, to make a recording available for playback when someone scans its QR code. This licence ends when you delete the content or your account/subscription ends, except where retention is required by law.
- Responsibility. You are responsible for the content you upload. You confirm that you have the rights necessary to record and share the content, including (where applicable) consent from anyone whose voice you record and any rights or licences needed for music or other copyrighted material in your recordings.
- Removal. We may remove content that we reasonably believe violates these Terms or applicable law, with notice to the account holder where practicable.
5. Acceptable Use
You agree not to use Chirp.QR to:
- Upload content that is unlawful, harmful, defamatory, obscene, threatening, hateful, harassing, or that infringes anyone's rights.
- Distribute malware, phishing links, or other harmful technology via QR codes.
- Impersonate another person or misrepresent your affiliation with any person or organisation.
- Send unsolicited messages, spam, or commercial advertising through Chirp.QR.
- Attempt to interfere with, disrupt, or compromise the security or operation of the Service.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service, except to the limited extent allowed by mandatory law.
- Use automated scraping, bulk-download, or rate-limit-evading techniques against the Service.
- Resell, sublicense, or commercially exploit the Service except under a valid school licence agreement or other written agreement with us.
- Use the Service in any way that violates applicable export, sanctions, or trade laws.
6. Intellectual Property
The Chirp.QR name, logo, brand, app, website, and underlying technology are owned by Chirp.QR / Sammy Pálsson and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of those rights to you.
You may use the Chirp.QR name and logo to identify Chirp.QR as the source of a recording (for example, on a printed worksheet with a Chirp.QR code) without prior permission. Beyond such identification use, you may not use our trademarks or branding without our written consent.
7. School Licensing
School licences are subject to these Terms, the additional information shown on chirpqr.com/schools at the time of purchase (including pricing tiers and device counts), and any separate written agreement signed between Chirp.QR and the school.
- Activation and scope. A school licence is activated by entering a single school code on a teacher or student device, which unlocks Chirp Premium features for that device. The licence covers up to the number of devices specified at purchase.
- Data roles. Where a school uses Chirp.QR under a school licence, the school is the data controller for any personal data of teachers and students processed through the Service, and Chirp.QR is the data processor. See Privacy Policy Section 7 for details. A Data Processing Agreement (DPA) is available on request from support@chirpqr.com.
- Restrictions. Schools may not transfer or sublicense the school code to other organisations or schools. Each school must have its own licence.
- Renewal and non-payment. School licences auto-renew yearly unless cancelled. If a renewal invoice is not paid by its due date, we will follow up; if non-payment continues after a reasonable grace period, the licence will be suspended and the school code will stop activating new devices. Existing devices may also lose Chirp Premium features at the end of the grace period.
- Cancellation by the school. A school can cancel the licence at any time from chirpqr.com/schools. Cancellation takes effect at the end of the current paid period.
- Cancellation by Chirp.QR. We may suspend or terminate a school licence for material breach of these Terms (for example, sharing the school code with other organisations), illegal use, or other serious misuse, with notice where practicable.
8. Suspension and Termination
- You may stop using Chirp.QR at any time. To stop being billed, cancel your Chirp Premium subscription through your Apple ID or your school licence through chirpqr.com/schools.
- We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or if continued operation poses a risk to the Service or other users. We will give notice where reasonable and practicable.
- On termination of a school licence: the school code stops activating new devices. Recordings made under the licence remain accessible until the end of the paid period. After that, recordings are deleted in accordance with our Privacy Policy unless the licence is renewed.
- Sections of these Terms that by their nature should survive termination (including but not limited to Sections 4 (Your Content), 6 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 12 (Governing Law)) will survive.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Chirp.QR disclaims all warranties of any kind, whether express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure, that defects will be corrected, or that the Service is free from harmful components. Nothing in these Terms excludes liability that cannot be excluded under mandatory consumer protection law.
10. Limitation of Liability
To the maximum extent permitted by law, Chirp.QR and its founder shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or related to your use of the Service.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid Chirp.QR in the twelve months preceding the event giving rise to the claim, or (b) one hundred euros (€100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law and the above limitations may not fully apply to you.
11. Indemnification
You agree to indemnify and hold harmless Chirp.QR and its founder from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) content you upload or share through the Service, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party. This clause does not apply to losses caused by our own breach of these Terms or by our negligence.
12. Governing Law and Disputes
These Terms are governed by the laws of Sweden, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the Swedish courts, except that you, as a consumer, may also bring proceedings in the courts of the country where you live, and you may be entitled to bring claims under your local consumer protection laws regardless of this clause.
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr to resolve disputes out of court.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. For material changes (changes that meaningfully affect your rights or obligations), we will give reasonable advance notice through the app, the website, or by email to school admin contacts. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree, please stop using the Service before the effective date.
14. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any school licence terms agreed at chirpqr.com/schools, constitute the entire agreement between you and Chirp.QR regarding the Service.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any right or provision will not be considered a waiver of those rights.
- Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms to a successor entity (for example, in connection with a sale of the business).
- Force majeure. We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control.
